Brown County Sheriff’s deputies arrested two men early Wednesday morning on burglary charges after an escalating family disturbance was reported.  Deputies responded to the report of a disturbance in the north Lake Brownwood area, a residence on Flagship Drive, around 2am on Wednesday which involved a male subject allegedly trying to break into a house with a pick ax, who was stating that he “would kill any cops that responded and was threatening suicide by cop,” reports state.

According to the report, while deputies were en route, the man smashed a window and was smashing the front door in an attempt to gain entry to the house.

When deputies Robert Ramirez and Nathan Land arrived, the man, identified as 29-year-old Timothy Darrell Cunningham of May, was located in the middle of the Flagship Drive with a wooden handled shovel in his hand, the report states.  According to Deputy Ramirez, Cunningham was quickly walking toward the deputies and yelling, “Shoot me, I’m not going to stop.”   The two deputies ordered Cunningham several times to drop the shovel and get on the ground; however he would not comply with their orders, continuing to advance toward the deputies in an aggressive manner, the report states.  He continued toward the deputies and raised the shovel in an attempt to swing it at Deputy Ramirez, continuing to yell for the deputies to shoot him, Ramirez reports.  Due to the imminent threat of death or injury posed to both deputies, Land deployed his taser striking Cunningham in the torso, which only kept him down for a few seconds when he got up and started toward the deputies again, the report states.  Deputy Land then drive stunned him with the taser in the back, which forced Cunningham to the ground where he was subdued and placed into custody, reports Ramirez.  At that time, a large laceration was noted on Cunningham’s arm, according to the report.

Investigation determined that the occupants of the house were relatives of Cunningham and that the suspect was intoxicated and had threatened the occupants, the report states.

Further investigation revealed that one of the relatives, 17-year-old Jesse James Brock of May, was Cunningham’s nephew and that the two had burglarized a home in the 4100 block of Thunderbird Drive, stealing alcohol reports state.  Cunningham sustained a deep laceration to the back of his arm during the burglary, the report states.

The report states that according to Brock, after Cunningham cut his arm, they returned to the residence on Flagship where Cunningham tried to sew up his own arm and then asked a female relative to sew it up for  him.  When she refused, he became enraged and started yelling and screaming at everyone in the residence and started beating up Brock and destroying the interior of the residence, the report states.  The occupants of the home were able to get Cunningham outside and locked him out of the residence and then called law enforcement for help, according to BCSO officials.

Items stolen from the home include 6 cases of beer, a bottle of vodka, a box of miscellaneous meats, 2 bottles of other alcohol, and 3 cases of colas. according to the report.  The burglarized residence also sustained damage estimated to be around $1000.

Cunningham was arrested and taken to Brownwood Regional Medical Center for surgery to repair the tendon in his arm due to the laceration and was later booked into the Brown County Jail on charges of Aggravated Assault on Public Servant, Aggravated Assault Causes Serious Bodily Injury Family Violence and Burglary of a Habitation.  Brock was also arrested for Burglary of a Habitation.
