District Attorney, Michael Murray said today that Phylecia Humphries had her probation revoked and was sent to the penitentiary for eight years.
Humphries was indicted in 2008 for sexually assaulting two of her foster sons. During one of her sexual assaults, Humphries was impregnated by her then thirteen-year-old foster child and later DNA tests proved the foster child to be the father of the defendant’s baby. The foster child testified in the December 2008 jury trial of Humphries that the relationship had been continuous while he was in the home. Both teens testified as to the sexual abuse they underwent while living in the Humphries’ home as foster kids. The jury assessed a ten year sentence against the defendant and fined her $10,000 and recommended probation to the judge.
In December of 2009, Humphries was arrested in Taylor County for driving while intoxicated when she ran into a guardrail driving on US 83/84 after a night of partying at a bar. The wreck sent her passenger to the hospital with injuries to her leg. Blood was taken from Humphries for testing which showed Humphries to be twice the legal limit.
During a Motion to Revoke hearing on Monday, Humphries pleaded true to seventeen violations of her probation including the driving while intoxicated. Humphries told the judge that she really learned her lesson this time and asked the judge to continue her on probation. District Attorney Michael Murray asked the judge to impose the ten year, $10,000 dollar fine that the jury had already assessed. Judge Stephen Ellis revoked her probation, but reduced the sentence from ten years down to eight years and waived the fine altogether. The evidence during the hearing showed that Humphries began violating her probation one month after being released from jail. Humphries parental rights to both of her biological children had been voluntarily terminated in a civil court hearing after she was convicted by the jury.
