District Attorney, Micheal Murray says that on Wednesday December 9, 2009, a Brown County jury found Alvin Leon Gaines guilty of delivery of a Controlled Substance in a Drug Free Zone. Gaines was accused of delivering less than one gram of cocaine to a cooperating individual back in January of this year. The delivery took place on Gaines’ property located at 604 Bailey Street which is near Cecil Holman Park, a drug free zone.
The case was based upon a controlled buy where Narcotic Investigator Bruce Spruill of the Brownwood Police Department surveiled a cooperating individual make the buy and recorded the transaction using video and audio surveillance equipment.
After the jury convicted Gaines, the jury heard punishment evidence concerning the defendant’s criminal history. District Attorney, Micheal Murray called Investigator Vance Hill to the witness stand and Hill identified the defendant as being the same Alvin Gaines who had twice previously been sent to the penitentiary for delivery of drugs. Testimony showed that Gaines received a total of 25 years on the previous two sentences.
The jury returned a punishment verdict of 20 years confinement in prison. The punishment range in this case was 2-20 years.
