Brownwood Police made a stop on a Jeep Liberty in the area of Avenue I and 15th Street for a traffic violation on Tuesday afternoon.
According to the report, the stop took place approximately 3:51 p.m. in the parking lot of Dr. Gwendolyn Allen’s office, within 1000 feet of the First Christian Church. As the vehicle came to a stop, the officer noticed the driver making furtive movements, the report states.
Upon contact, the officer asked the driver, identified as 18-year-old Dustin Marshall of Brownwood, why he was moving around in the vehicle after the officer activated his lights. Marshall mumbled something the officer could not understand and appeared to be very nervous, his hands visibly shaking and he was sweating profusely, according to the officer’s report. When asked if he had anything illegal in the car or on his person, Marshall denied having anything illegal, the report states. The officer noticed sores on Marshall’s arms and face, which are often present on people who abuse methamphetamine and are often caused by self scratching when using the drug, along with probable injection marks on his elbows, the report states. Marshall admitted having used methamphetamine approximately two weeks prior to the traffic stop, according to the report.Based on Marshall’s behavior during the stop and his admission of using methamphetamine in the past, the officer asked for consent to search the vehicle; however a search of the vehicle and Marshall’s person was denied, the report states. The officer called for the Brown County Sheriff’s Office K-9 unit to assist in a free air sniff around the car, which resulted in the canine giving a positive alert on the driver’s side of the vehicle. When searching the interior of the vehicle, the canine alerted to the driver’s seat. Although nothing was found in the interior of the vehicle, a search of Marshall’s person found a baggie containing a large amount of suspected methamphetamine hidden in Marshall’s underwear, according to the report. The methamphetamine, along with packaging weighed 7.4 grams, an amount the officer believed to be more than one person would have for personal use, the report states.
When asked what he was doing with such a large amount of methamphetamine, Marshall explained to the officer that he “was trying to make money to pay his bills” and that he intended to sell the methamphetamine for approximately $700 so that he could pay his bills, the report states.
Marshall was arrested and charged with manufacture delivery of a controlled substance penalty group 1 greater than 4 grams less than 200g in a drug free zone (due to being within 1000 feet of the First Christian Church which houses the Latchkey childcare program).
