LECSmBrownwood Police received a report of the theft of a cell phone from an employee at Chili’s Restaurant on Monday, around 12:22pm.

According to the report, the complainant (the employee’s father) called police and reported that a male came into Chili’s and asked the employee for a plastic bag.  The report states that when she went to retrieve the bag, she left her cell phone which was missing, along with the man, when she returned.  The complainant asked police to meet him at Ben Lednicky Park, where the cell phone GPS tracking indicated its presence.  When officers Bastardo and Miller along with the complainant arrived at the park, they noted two males sitting across the bayou on the bank near Humphrey Pete’s.

Officer Miller and the complainant walked across the bridge to the subjects who held up the cell phone and said, “I guess you are looking for this” and handed the phone to the officer, the report states.  The man, identified as 28-year-old Marshall Colt Williams, was arrested for theft.  Another officer, Cpl. Kenyon Black, arrived on scene and noticed Williams’ open back pack contained a metal container and when asked what that was, Williams stated it was a grinder, the report states.  Knowing that grinders are used to cut up larger pieces of marijuana, the officer opened the grinder and noted a smell of marijuana, according to the report.  A pipe was also found protruding from under the backpack.  The second man stated that he knew nothing about Williams having narcotics or paraphernalia and was released from the scene.

After questioning, the suspect led Officer Miller to a hollow tree stump where two baggies of marijuana, a glass pipe (which later tested positive for methamphetamine), and a digital scale were found, the report states.

Williams was transported back to Chili’s where he was positively identified as the male who asked for the bag.  He was then transported to the jail where he was charged with Possession of a Controlled Substance Penalty Grade 1 less than 1 gram; Possession of Drug Paraphernalia; Possession of Marijuana less than 2 oz; and Theft of Property $50-$500.

While at the jail, a search of William’s backpack was conducted which contained 3 cellular phones, 3 digital cameras, a GPS, an electric hair trimmer and attachments, a container full of various memory/SIM cards, a pair of khaki shorts, 2 baseball caps, a Bible, a cigarette package with lighters and rolling papers, 6 Lortadine tablets, a prescription issued to Williams, a plastic mug , a container of caramel sauce, a container of chocolate flavored fudge, a toboggan hat, a pair of sunglasses, a disposable razor, a pad lock and a zebra print cloth, the report states.  Based on the theft of the cell phone, as well as the numerous electronic devices found in the bag, officers secured the bag and its contents as evidence at Brownwood Police Department for further investigation.
