Brownwood Police were dispatched to the 1800 block of 8th Street regarding a juvenile problem at approximately 1:21am Saturday. According to the report, the caller stated that Dustin Atkins, 17, who also lives at the home was smoking “pot” and that she could not control Atkins and requested an officer’s assistance. According to the report, when officers arrived at the residence, the complainant stated that Atkins had left in a pickup truck. She also stated that she was unsure of what kinds of drugs Atkins had been using, the report states. Her husband had been assaulted earlier in the day by the suspect, according to police.
At 2:22am, an officer noticed a suspicious male on a skateboard in the 800 block of Center Avenue and then saw the subject, identified as Atkins, run from the Davis-Morris Funeral Home parking area to a parked truck. According to the report, the subject yelled, “I didn’t do anything wrong.” He began slowly driving, leading the officer down E. Depot to the intersection of E. Adams and Fisk Avenue, where police attempted to initiate a stop. Caution was taken with the subject who is known to have or had used a gun, the report states. Repeated instructions to get out of the vehicle with his hands in the air were ignored by Atkins who then started his truck back up and continued to drive, turning onto Fisk and proceeding onto Austin Avenue, then continuing on Coggin, the report states. He then meandered through residential neighborhoods near his own home, continuing to the intersection of Avenue K and 11th Street where he drove between two patrol units which were positioned to block the road; however one officer put his vehicle in reverse to avoid a collision as it appeared Atkins was going to strike his vehicle, reports state. At one point of the slow speed chase, Atkins was approached by an officer’s vehicle in the opposite direction on 10th Street, where he nearly hit the officer’s unit head-on, the report states. The officer was able to swerve to miss being struck and Atkins continued on to his residence in the 1800 block of 8th Street.
When Atkins arrived at the residence, he followed police commands to get on the ground and was subsequently arrested for evading in a vehicle and attempted aggravated assault on a public servant due to his using his vehicle (a deadly weapon) almost striking the officer’s unit twice during the incident, according to the report.
According to the report, an officer reported that Atkins did not appear intoxicated, but a slight odor of alcohol was detected on his breath. The officer also noted that the pursuit never exceeded 40 mph, which was on Austin Avenue in a 40 mph zone, that Atkins stopped at most stop signs, signaled most turns and drove at relatively slow speeds, well below the speed limit on residential streets. He was swerving while driving but due to the late hour, there was little traffic on the roadways and the pursuit posed little to no threat to the public, police reports state.
