District Attorney Micheal Murray reports that on May 12, 2010, a Brown County jury found Carl Anthony Webb guilty of felony Driving While Intoxicated and sentenced him to 99 years imprisonment. The charge of Driving While Intoxicated is classified as a third degree felony when a person has been convicted of at least two previous instances of Driving While Intoxicated.
The trial for this case began on Monday, May 10, 2010. During the course of the trial, evidence was presented which showed that Webb had been convicted of three previous instances of Driving While Intoxicated. Webb was also shown to have had a blood alcohol level of 0.17, more than twice the legal limit, while driving his car in Brownwood on March 28, 2009. The jury heard evidence for two days before returning its verdict of guilty.
During the punishment phase of the trial, the District Attorney showed the jury that Webb had also been convicted of five previous felony offenses: Aggravated Sexual Assault, Possession of a Controlled Substance, Attempted Sexual Assault, Aggravated Robbery and Burglary of a Building. He had been sentenced to the State Penitentiary for each offense for a total of 32 years. Additionally, the jury heard evidence of Webb’s arrest for another DWI, which has not yet been tried, and an attempted Aggravated Sexual Assault with a knife. The range of punishment for this case was from 25 to 99 years, or life, because of Webb’s criminal history. After hearing all the evidence, the jury deliberated for several hours before returning a sentence of 99 years imprisonment. Judge Stephen Ellis, who presided over the trial, pronounced sentence on Wednesday evening.
