A recommendation of a motion to pass an ordinance of a first/final reading calling for a Special Election to be held on Saturday May 8, 2010, in conjunction with the General Election to fill the vacated seat of the Council member (H.D. Jones) from Ward 2. The filing period for this position is during March 23, 2010 through April 7, 2010. City Manager Rountree quoted the Attorney General’s opinion that, “our city charter calls for us to appoint one (a council member to fill the vacancy), but because of the four year term, the city should call a special election.” This motion was also unanimously approved.

James Bailey of Krischke & Co. presented the audit report for the year ending September 30, 2009. Bailey reviewed the audit with the council. He stated, “The city had a good year. The independent audit showed no qualifications to the report. Government funds had no questions.” The state of net assets, included days of cash coverage, which was 49 days. Bailey said this was down from last year and that he would like to see this at 60 days. Both Bailey and City Manager Bobby Rountree mentioned that these are trying times, to which Bailey replied, “…especially with sales tax down”.
Summarizing the audit, Bailey stated that, “I feel that the council has done a good job and kept the city in good shape.”
The next item on the agenda was consideration of approving Change Order Number 2 to the Camp Bowie Sports Complex to Fain Construction of Fort Worth on February 15, 2010 in the amount of $4,083,800. The first change order was approved for a deduction of -$287,000 lowering the current contract price to $3,796,800. Change Order Number 2 includes an elimination of the 25-year warranty by Musco Lighting. This warranty included a computerized monitoring system that would notify Musco if the lighting was not working properly. The basic warranty will still be included in the contract. Rountree noted that “we think when we are out there playing ball; we will be able to tell if lights were out.” The next deduction of -$20,000 eliminates the warm-up lights between the fields and associated power supply. The field lights are felt to be able to provide adequate lighting for pre-game warm-up. This change order was unanimously approved and totaled a savings to the contract of $217,000.
Council also approved a resolution endorsing certain legislative changes relating to the Sunset review of the Texas Public Utility Commission and the special purpose review of the Electrical Reliability Council of Texas by Cities Aggregation Power Project, Inc. (CAPP).
